Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Fixoral platform (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Fixoral provides homeowners with home-maintenance scheduling, reminders, and property records, and operates a marketplace that connects homeowners with independent service providers. Fixoral is a platform; we are not a party to any agreement for services performed between a homeowner and a provider.

2. Accounts & eligibility

You must be at least 18 years old and provide accurate information. You are responsible for safeguarding your account credentials and for all activity under your account.

3. Homeowners

Maintenance schedules, task suggestions, and property data (including data sourced from RentCast and weather data from the National Weather Service) are provided for informational purposes only, on an “as is” basis, and are not guaranteed to be accurate, complete, or suitable for your specific property. You are responsible for decisions about your home.

4. Service providers

• Providers access the marketplace via a paid subscription billed through Stripe (see Section 5).
• Providers are independent businesses, not employees or agents of Fixoral. You are solely responsible for your services, licensing, insurance, and compliance with applicable law.
• Fixoral does not guarantee any volume of leads, requests, or revenue.

5. Payments & subscriptions

Provider subscriptions are recurring and billed in advance through Stripe until cancelled. You authorize us and Stripe to charge your payment method on a recurring basis. You may cancel from your account; cancellation stops future renewals but does not, except where required by law, entitle you to a refund for the current billing period. Failed payments may result in suspension of marketplace access.

6. Marketplace disclaimer

Fixoral does not employ, endorse, or guarantee any provider and is not responsible for the quality, safety, legality, or outcome of any services arranged through the marketplace. Any agreement, payment for services, dispute, or liability is solely between the homeowner and the provider.

7. Notifications & SMS

By enabling email or SMS notifications you consent to receive them. SMS is subject to the messaging terms described in our Privacy Policy (recurring automated messages; message and data rates may apply; reply STOP to opt out, HELP for help).

8. Acceptable use

You agree not to misuse the Service, including by attempting to access data that is not yours, scraping, overloading or probing the Service, uploading unlawful content, or interfering with its operation or security.

9. Intellectual property

The Service, including its software, branding, and content (excluding content you submit), is owned by Fixoral and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIXORAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO FIXORAL IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold Fixoral harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the Service.

14. Governing law

These Terms are governed by the laws of [GOVERNING JURISDICTION — e.g. State of ___, USA], without regard to conflict-of-laws principles.

15. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
